RJ Living Members - Terms & Conditions

1. About these Terms

  1. These Members Terms & Conditions (Terms) govern the RJ Living Members Program (Members Program) operated by RJ Living Pty Ltd ACN 672 616 447 (RJ Living or our).
  2. By joining the Members Program, you agree to be bound by these Terms.
  3. These Terms operate in addition to the RJ Living Website & Order Terms & Conditions and Privacy Policy, which are available on our website.

2. Eligibility

  1. Membership is available only to individuals aged 18 years or over.
  2. Membership is free.
  3. To become a Member, you must create an RJ Living account online or in an RJ Living showroom and provide the information requested by RJ Living.
  4. You must ensure your account information remains accurate and up to date.
  5. Trade customers and any other customer categories designated by RJ Living from time to time are not eligible to participate in the Members Program unless expressly approved by RJ Living.
  6. Membership is personal to you and must not be transferred, assigned or shared.

3. Membership

  1. Membership commences once RJ Living accepts your application.
  2. RJ Living may refuse an application where:
    1. eligibility requirements are not met;
    2. fraudulent or misleading information has been provided;
    3. multiple accounts have been created to obtain additional benefits; or
    4. RJ Living reasonably believes participation would be inconsistent with these Terms.

4. Member benefits

  1. Subject to these Terms, Members may receive one or more of the following benefits:
    1. permanent member pricing;
    2. exclusive member promotions;
    3. complimentary design consultations;
    4. early access to selected product launches;
    5. early access to selected promotional campaigns; and
    6. any additional benefits offered by RJ Living from time to time.
  2. Benefits are personal to Members and have no cash value unless expressly stated otherwise.

5. Member discount

  1. Members are entitled to receive a 15% discount off the recommended retail price (RRP) of eligible products.
  2. Unless otherwise stated:
    1. the discount applies only to the current RRP;
    2. the discount cannot be redeemed for cash;
    3. the discount cannot be transferred; and
    4. only one Member discount may be applied per transaction.
  3. The Member discount does not apply to:
    1. RJ Living outlet products;
    2. RJ Living warehouse sales;
    3. selected brands including Citta and Lighting Republic (or any replacement excluded brands);
    4. gift cards;
    5. delivery charges;
    6. installation services; or
    7. any other products or services identified by RJ Living from time to time.

6. Other promotions

  1. Unless RJ Living expressly states otherwise, Member discounts cannot be used together with:
    1. sale prices;
    2. promotional offers;
    3. discount codes;
    4. trade pricing;
    5. commercial pricing;
    6. staff discounts; or
    7. any other promotional offer.
  2. Unless RJ Living expressly states otherwise, discounts and promotional offers cannot be combined. Where more than one discount or promotional offer is available in respect of the same purchase, only the single discount or promotional offer expressly identified by RJ Living as applicable will apply.

7. Exclusive member offers

  1. RJ Living may offer Members exclusive promotions from time to time.
  2. Exclusive promotions may:
    1. be available only during specified periods;
    2. apply only to selected products;
    3. be subject to stock availability;
    4. be subject to additional terms.

8. Early access

  1. Members may receive early access to selected:
    1. product launches;
    2. collections;
    3. promotional events; or
    4. campaigns.
  2. Early access periods are determined by RJ Living and may differ between promotions.
  3. Early access does not guarantee product availability.

9. Complimentary design consultations

  1. Members may book complimentary design consultations where offered by RJ Living.
  2. Consultations are:
    1. subject to availability;
    2. available only during published booking times;
    3. subject to any booking requirements notified by RJ Living.
  3. RJ Living may impose reasonable limits on consultation bookings.

10. Marketing communications

  1. During registration you may be invited to subscribe to marketing communications from RJ Living.
  2. Marketing communications may include information regarding:
    1. products;
    2. promotions;
    3. events;
    4. exclusive Member offers; and
    5. other RJ Living news.
  3. You may unsubscribe from marketing communications at any time using the unsubscribe facility provided.
  4. Unsubscribing from marketing communications does not automatically terminate your membership.
  5. RJ Living may continue to send operational communications relating to your membership, account or purchases where permitted by law.

11. Privacy

  1. RJ Living collects personal information to:
    1. administer the Members Program;
    2. verify eligibility;
    3. provide Member benefits;
    4. administer your account;
    5. improve our products and services; and
    6. otherwise as described in our Privacy Policy.
  2. Personal information will be handled in accordance with RJ Living's Privacy Policy.

12. Member responsibilities

Members must:

  1. provide accurate information;
  2. maintain the security of their account;
  3. comply with these Terms;
  4. not misuse the Members Program;
  5. not engage in fraudulent or dishonest conduct.

13. Suspension and termination

  1. RJ Living may suspend or terminate a membership where it reasonably believes a Member has:
    1. breached these Terms;
    2. engaged in fraudulent activity;
    3. misused Member benefits;
    4. engaged in unlawful conduct; or
    5. otherwise acted in a manner that may adversely affect RJ Living or other Members.
  2. Where reasonably practicable, RJ Living will notify the Member before terminating membership.
  3. A Member may cancel their membership at any time by contacting RJ Living.
  4. Upon termination:
    1. all unused Member benefits immediately expire;
    2. future Member discounts cease to apply.

14. Changes to the Members Program

  1. RJ Living may, acting reasonably, from time to time:
    1. introduce, amend, suspend or remove any Member benefits;
    2. amend eligibility requirements for the Members Program;
    3. amend the operation, structure or administration of the Members Program;
    4. amend these Terms; or
    5. suspend or discontinue the Members Program.
  2. RJ Living will provide Members with reasonable prior notice of any material amendment to these Terms or the Members Program that is likely to have a materially adverse effect on Members, unless:
    1. the change is required by law;
    2. the change is necessary to protect the security or integrity of the Members Program;
    3. the change is required to prevent fraud, misuse or unlawful conduct; or
    4. it is otherwise not reasonably practicable to provide prior notice.
  3. RJ Living may notify Members of changes by publishing the updated Terms on its website, by email, through a Member account or by any other reasonable means.
  4. Subject to applicable law, continued participation in the Members Program after the effective date of any amended Terms constitutes acceptance of those amended Terms.
  5. If a Member does not agree to a material amendment to these Terms, the Member may cancel their membership at any time by notifying RJ Living.

15. Liability

  1. Nothing in these Terms restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
  2. To the extent permitted by law, RJ Living is not liable for any loss, damage, cost or expense arising out of or in connection with:
    1. the suspension, interruption, modification or discontinuance of the Members Program;
    2. the temporary or permanent unavailability of any Member benefit;
    3. the withdrawal, expiry or amendment of any Member benefit in accordance with these Terms;
    4. any delay or failure in providing Member benefits due to events beyond RJ Living's reasonable control, including system failures, telecommunications outages, industrial disputes, acts of God, natural disasters or government action;
    5. unauthorised access to, or use of, your membership account resulting from your failure to keep your account credentials secure;
    6. any inability to access or use the Members Program due to maintenance, upgrades or technical issues affecting RJ Living's website, systems or third-party service providers; or
    7. any indirect, incidental, special or consequential loss, including loss of profits, loss of opportunity or loss of goodwill.
  3. RJ Living does not warrant that:
    1. the Members Program or any Member benefit will be available at all times;
    2. any particular Member benefit will continue to be offered for any minimum period; or
    3. the Members Program will operate without interruption or error.

16. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

17. General

  1. If any provision of these Terms is invalid, the remaining provisions continue in full force and effect.
  2. These Terms constitute the entire agreement between RJ Living and each Member in relation to the Members Program.
  3. These Terms are governed by the laws of Victoria, Australia.
